Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Massage Scribe AI application and website (the "Service"), operated by UTTERWARE SRL, Spl. Independenței 202 B, Cam. 42, Sectorul 6, Bucharest, Romania ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Massage Scribe AI is a documentation tool that helps massage therapists draft, store, and export clinical session notes, including AI-assisted note generation and optional voice transcription. The Service is a productivity aid and does not provide medical advice.

2. Eligibility & accounts

You must be a professional using the Service in connection with your practice, and legally able to enter into these Terms.
You are responsible for the accuracy of your account information and for keeping your credentials secure.
You are responsible for all activity under your account.

3. Your responsibilities & client data

You are responsible for obtaining any consent required to record and process your clients' information in the Service.
You must use the Service in compliance with all laws and professional obligations that apply to your practice.
You retain responsibility for the clinical accuracy and appropriateness of every note you save, export, or rely upon.

4. AI-assistance disclaimer

Notes and home-care text are generated with the assistance of AI and may contain errors or omissions. You must review and edit every AI-generated output before using it. The Service does not practice medicine, does not provide clinical judgment, and is not a substitute for your professional expertise. You are solely responsible for the content of your records.

5. Subscriptions & billing

The Service offers a free tier and a paid "Pro" subscription at $17.99 per month or $139 per year (prices may change; the price shown at purchase applies).
Subscriptions are sold and billed through the Apple App Store or Google Play, subject to their terms. Payment is charged to your store account at confirmation of purchase.
Pro may be offered with a 7-day free trial for new subscribers. If you start a free trial you are not charged until it ends; cancel any time before then to avoid a charge. Any unused portion of a free trial is forfeited when you purchase a subscription.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription in your App Store or Google Play account settings.
Refunds are handled by the applicable app store under its refund policy.

6. Acceptable use

You agree not to:

Use the Service unlawfully or to infringe others' rights.
Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service or its systems.
Upload content you have no right to process, or misuse the AI features to generate harmful or misleading material.

7. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by us and protected by law. You retain ownership of the content and records you create. You grant us the limited rights needed to operate the Service for you (for example, transmitting your inputs to the sub-processors described in our Privacy Policy).

8. Third-party services

The Service relies on third-party providers (including Supabase, Anthropic, AssemblyAI, RevenueCat, and Firebase). Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for third-party services outside our control.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. You can export your data before deletion (see Settings → Data & Privacy).

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Romania, without regard to conflict-of-laws rules. The courts located in Bucharest, Romania will have jurisdiction over any dispute arising from these Terms.
